INDIVIDUAL ACTIONS, INSTITUTIONAL RESPONSIBILITY

The recent incident involving a bouncer at Naamin Sports Lounge in Kagio has stirred public attention and raised legal, ethical and social questions about the treatment of customers in entertainment venues. A viral video showing a young man, Dennis Konye being violently assaulted inside the club sparked widespread outrage leading to calls for justice and accountability.

However, as the dust begins to settle, it’s important to draw a clear distinction between the actions of the individual bouncer and the institution itself.

Naamin Sports Lounge, a well-known establishment in Kagio town has not been directly implicated in orchestrating or endorsing the assault. From a legal standpoint, businesses are only held accountable for the actions of employees if it can be proven that those actions were encouraged or covered up due to negligence. As of now, no such claims have been substantiated publicly against the management.

The core of the matter lies in the conduct of the security personnel involved. According to the footage circulated online, the bouncer appears to assault the young man, who seems to be unarmed and visibly intoxicated. The situation escalated beyond acceptable standards of security engagement. In fact, the bouncer is heard shouting threatening language, statements that have further intensified public concern.

This leads to a crucial question: What laws may have been broken? Kenyan law under the Penal Code clearly outlines several offences in such scenarios. Assault, use of excessive force and issuing threats are criminal offences that carry legal consequences including imprisonment. If proven, these are individual crimes and not institutional ones unless further investigations prove otherwise.

However, businesses like Naamin Sports Lounge must also reflect on their protocols. Incidents like these even if carried out by a rogue employee can severely tarnish the reputation of an entire establishment. It’s essential for businesses to train their staff on legal limits, conflict de-escalation and customer rights.

To their credit, Naamin Sports Lounge has not denied that the incident occurred. However, silence or inaction from their end could risk appearing complicit. For businesses, public trust is earned not by denying responsibility but by taking swift, transparent measures to address wrongdoing and ensure accountability.

In conclusion, while the law will determine individual guilt or innocence, the public also expects institutions to act with integrity. As investigations continue, it remains vital that the focus stays on justice and not assumptions. The rights of every person including the accused, the victim and the institutions must be respected.
